Terms of Service

Welcome to BracketSpot. These Terms of Service ("Terms") govern your use of the BracketSpot tournament management platform ("Service"). By accessing or using our Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using BracketSpot, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
You must be at least 13 years of age to use this Service. By using the Service, you represent that you are at least 13 years old.
2. Description of Service
BracketSpot provides:
- Tournament bracket generation and management
- Real-time match scoring and tracking
- Live displays on any screen — bracket, match, flyer, timer and stream
- Player registration and check-in systems
- Organizer-set entry fee display (entry fees are collected by the organizer at the venue, not by BracketSpot)
- Analytics and player ranking systems
3. User Accounts
When you create an account, you agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access
- Accept responsibility for all activities under your account
You may only create one account per person. We reserve the right to suspend or terminate accounts that violate these Terms.
4. User-Generated Content
You retain ownership of content you submit to BracketSpot (tournament names, descriptions, flyer images, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Service.
Prohibited Content
You may not submit content that:
- Is illegal, harmful, threatening, abusive, or harassing
- Infringes on intellectual property rights
- Contains malware, viruses, or malicious code
- Impersonates another person or entity
- Is sexually explicit or promotes violence
- Violates the privacy of others
We reserve the right to remove any content that violates these Terms without notice.
5. Payment Terms
Entry Fees
Entry fees are set by each tournament organizer and paid directly to them at the venue. BracketSpot does not process, collect, or hold entry fees and takes no cut or processing fee on them — we only display the amount the organizer sets so players know the cost before they register.
Subscription Plans
BracketSpot offers subscription plans for tournament organizers. Subscription fees are billed in advance on a monthly or annual basis, following any applicable free trial period. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
Free trial. A new paid subscription begins with a 14-day free trial. Your payment method is collected at checkout but is not charged until day 15. You may cancel at any point during the trial at no cost. Upgrading an existing paid subscription does not start a new trial, and the Free plan requires no payment method and has no trial.
Plan changes and proration. You may change your plan, or switch between monthly and annual billing, at any time. Changes take effect immediately and your billing is prorated: the unused remainder of your current period is credited against the new plan.
Refunds
Because entry fees are paid directly to the organizer, any entry-fee refund is handled by that organizer under their own policy. BracketSpot does not hold entry-fee funds and is not responsible for refund disputes between participants and organizers. Subscription refunds are governed by the cancellation terms above.
Service Level Commitment (Enterprise)
For Enterprise subscriptions only, we commit to 99.9% monthly uptime for the tournament dashboard and the public results pages. Uptime is measured per calendar month as the percentage of minutes the Service responds successfully, excluding the cases listed below. This commitment is an express exception to the warranty disclaimer in Section 7.
If we fall short in a given month, you may claim a service credit against your next invoice: 10% of that month's subscription fee if uptime is below 99.9%, 25% if below 99.0%, and 50% if below 95.0%. Service credits are the sole and exclusive remedy for missed uptime. To claim, email [email protected] within 30 days of the end of the affected month.
Excluded from measurement: scheduled maintenance announced at least 48 hours in advance; downtime caused by your own configuration, network, or hardware; and outages originating with a third-party provider outside our control, such as a CDN, payment processor, or upstream network provider. Plans other than Enterprise are provided without an uptime commitment.
6. Intellectual Property
The BracketSpot platform, including its design, features, and code, is owned by BracketSpot and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.
User-generated content remains the property of the users who created it, subject to the license granted in Section 4.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We are not responsible for any losses resulting from the use of the Service.
Exception. This section is subject to the Service Level Commitment in Section 5, which applies to Enterprise subscriptions. Nothing in this section limits that commitment or the service credits it provides.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRACKETSPOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Dispute Resolution
Binding Arbitration
Any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Small Claims Exception
Either party may bring an individual action in small claims court for disputes within the court's jurisdiction.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
10. Termination
You may terminate your account at any time by contacting us at [email protected].
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice.
Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, and limitations of liability.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective Date." Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
